Vol. 94 No. 9

Ceisteanna—Questions. Oral Answers. - Condition of Dublin Mountain Road.

asked the Minister for Finance if he is aware that the bog road leading from Glendhu Bog in the Dublin mountains is in a dangerous state of repair; that this affects about 300 people who have taken bog plots, and that there are about 2,000 tons of turf to be removed; and if, in view of this, he is prepared to have the matter remedied immediately.

As indicated in the letter addressed to the Deputy on 31st August, the owner of the turbary area will not give his consent to the construction by my Office of a road through his lands. I understand that when making the lettings in 1944 the owner undertook himself to provide road accommodation to the bog, but this undertaking was not observed. The action to be taken in connection with the 1945 lettings on this bog is under consideration by the Department of Supplies.

Cannot compulsory powers be used in this matter?

In so far as my office is concerned, as we made the Deputy aware in the letter to which I have referred, we have no powers to compel the owners of these bog lands to permit us to make roads through them.

But are there not compulsory powers which could be used?

Whatever powers there are, they are not exercisable by my office.
