Ceisteanna—Questions. Oral Answers. - Prosecution of Dairy Proprietor.

asked the Minister for Agriculture if his attention has been directed to the prosecution and conviction of a dairy proprietor on the 23rd May, 1949, in the course of which it was revealed that milk was produced for sale to the public under revoltingly insanitary conditions; and if he will state what action he proposes to take in the matter.

The dairyman referred to was prosecuted by the Dublin Corporation, who are the responsible authority in this matter, for a number of offences under the Milk and Dairies Act, 1935. The question whether any further action should be taken is a matter for decision by the Dublin Corporation under the provisions of Section 26 of the Milk and Dairies Act.

Considering the enormity of the offence, does the Minister consider the penalty imposed in this case adequate?

It would scarcely be appropriate for a Minister to express an opinion upon a decision of a district justice or other judicial person.

I agree, but would the Minister agree that this is a very sad commentary on our standard of public health in the country?

I would not so agree and, no doubt, Dublin Corporation will do, in this matter as it does in other matters under the general supervision of the Minister for Health, anything necessary for the protection of the public health.
