Ceisteanna—Questions. Oral Answers. - State Pensioners.

asked the Minister for Finance if he will state (1) the number of Civil Service pensioners who were denied any benefits under the Pensions (Increase) Act, 1950, by reason of the penal provisions of the Civil Service (Transferred Officers) Compensation Act, 1929; (2) the number of such persons relieved under the recent British ex-gratia grant and (3) the amount of such grant payments sanctioned for (a) Civil Service pensioners; (b) Dublin Metropolitan Police pensioners and (c) all other pensioners.

The Pensions (Increase) Act, 1950, did not apply to persons in receipt of compensation under Article 10 of the Treaty, and payments under that Act could not accordingly be affected by the provisions of the Civil Service (Transferred Officers) Compensation Act, 1929, which governed the grant of compensation under Article 10 to certain civil servants.

Under paragraph 13 of the agreement scheduled to the Civil Service (Transferred Officers) Compensation Act, 1929, the British Government agreed to supplement the compensation payable under Article 10 of the Treaty to civil servants who, before the 1st March, 1929, were discharged from or who gave notice of their intention to retire from the service of the Irish Government. The British Government have also agreed to supplement, on an ex-gratia basis, the compensation payable under Article 10 to civil servants who on or after the 1st March, 1929, were discharged from or who gave notice of intention to retire from the service of the Irish Government provided that service terminated before the 1st November, 1946. They have also agreed to supplement the compensation payable to members of the Dublin Metropolitan Police. These ex-gratia supplements are calculated on the same basis as the increases provided for other pensioners under the Pensions (Increase) Act, 1950, and are payable as from the 1st April, 1951. The annual amount payable in the year 1951-52 is estimated at £9,610 in respect of 245 former civil servants (including Petty Sessions clerks) and £10,250 in respect of 414 former members of the Dublin Metropolitan Police (including widows). No other pensioners are affected.
