Vol. 136 No. 2

Ceisteanna—Questions. Oral Answers. - Road Traffic Acts.

asked the Minister for Local Government if he is aware that it has recently been decided in the High Court that registration of ownership under the Road Traffic Acts is not conclusive evidence of the ownership of a motor vehicle and that in consequence, therefore, proceedings against the registered owner and the insurer under the Road Traffic Acts of such registered owner can be nugatory and that, therefore, persons injured by a vehicle where the registered owner is only a nominee can have no redress; and, if so, whether he will accordingly introduce proposals for legislation to rectify this omission.

I am not clear as to the High Court case to which the Deputy is referring. If the Deputy will send particulars to my Department I will arrange to have inquiries made.
