Ceisteanna—Questions. Oral Answers. - Preservation of Amenities at Seaview Terrace, Ballsbridge.

asked the Minister for Local Government whether he has received representations from residents in the area of Nutely Road, Ballsbridge, in reference to the attempted felling of a copper beech tree opposite Seaview Terrace and the building of house on the plot of ground opposite Seaview Terrace; and whether he has any power under the Town Planning Act to prevent the proposed destruction of the tree or the building of the houses.

I have received representations from a number of residents of Nutley Road, Ailesbury Road and Seaview Terrace in reference to the felling of a tree and the building of houses on a site opposite Seaview Terrace. I have, however, no power to intervene in the matter at this stage. I understand that the planning authority granted permission for the building of five detached houses on the site in quesiton, subject to the preservation of such trees as did not interfere with the building operations. No appeal was made to me within the presceibed period and I have, therefore, no functions in the matter.

Could the Minister say whether or not any portion of this matter ever came before his Department?

Not that I am aware of.

asked the Minister for Local Government if any steps will now be taken, by an amendment of the Final Town Plan, to preserve the amenity of private open space and the trees thereon, facing the houses in Seaview Terrace, Ballsbridge.

My consideration of the general planning scheme for the county borough must await the expiration of the period provided for the submission to me of objections and subsequently the consideration of the scheme as a whole.

As indicated in my reply to the last question, I have no power to review the particular decision of the planning authority to which the Deputy refers.
