Ceisteanna—Questions. - Finance Act 1946: Prevention of Unlawful Arrest and Imprisonment.

asked the Minister for Finance whether he has considered the question as to whether or not the duties of the Commissioner and officers of the Gárda Síochána to arrest and imprison a person under the provisions of Section 27 and the Third Schedule of the Finance Act, 1946, are repugnant to the provisions of the Constitution; and, if he is advised that they are so repugnant, what steps he proposes to take to prevent unlawful arrest and imprisonment.

I am advised that the enactment in question is not repugnant to the provisions of the Constitution; and accordingly the second part of the Deputy's question does not arise.

May I inquire if that advice is tendered to the Minister by the law officers of the Government—by the Attorney-General?

I hope you get a new Attorney-General before long.

The Attorney-General will not matter very much.

We might give him a run for his money.
