Vol. 189 No. 11

Ceisteanna—Questions. Oral Answers. - Property taken into Cork County Borough: Compensation Question.

25.

asked the Minister for Local Government if he is aware that no compensation has yet been paid by the Cork Corporation to the Cork County Council for rateable property taken into Cork County Borough five years ago; and that no provision for compensation has been made in this year's Corporation estimates: and what steps it is intended to take to ensure that a sufficient rate is struck by Cork Corporation to cover their legal obligations in this regard: if he is further aware that the Cork County Council submitted their claims for a compulsory adjustment on this matter in August, 1957; and what is the reason for the delay in deciding the matter.

Cork County Council's claim in respect of an increase in burden was submitted under eleven heads, nine of which have been fully examined. The remaining items relate to Health Services and are complicated by the alteration in the areas of chargeability consequent on the Health Act, 1953. It is hoped, however, to determine the application for a compulsory adjustment before the end of this year. Until such determination is made, the question of the inclusion of a provision in the Cork Corporation's estimates does not arise.

Would the Minister not consider it right that, before instituting a new inquiry for a further extension of the borough boundary, those gentlemen should pay what they owe?
