andMr. McQuillan asked the Minister for Industry and Commerce whether, before issuing his warning to the Irish assurance companies and others that the practice, about which a case was recently taken in the High Court, was illegal under the Insurance Act, 1936, he consulted the Attorney General.

I have had no consultations with the Attorney General in the matter. A decision regarding the legality of the insurance policies in question is a matter for the courts.

Did he give information to the Minister, under Section 110 of the 1936 Insurance Act, concerning the possible illegality of the practices being carried on.

I got the necessary information without having recourse to the Attorney General. There was no necessity for the Attorney General to inform me.

Before the Minister took his decision, did he consult any legal officer of the State? Did he make his decision personally as Minister or in accordance with the advice of legal officers of his Department?

I made the decision personally after I had advice from my own officers within my own Department.

The Attorney General was at no time consulted in the matter?
