asked the Minister for Local Government if he is aware that, while some insurance companies are giving cover to small public service vehicles for ten passengers plus a driver, the vehicles are allowed to carry only six passengers under their public service vehicle licences; and if he will make a statement on the matter.

I am not aware that the position is as stated by the Deputy. It is illegal to carry ten passengers for reward in a small public service vehicle. The enforcement of the law is a matter for the Garda authorities.

Will the Minister say if he is aware that a minibus which is constructed to carry ten or 12 passengers and is insured for ten passengers and a driver is, in fact, allowed to carry only six passengers? Will he say whether or not the person using that type of vehicle can carry ten passengers without the risk of prosecution?

If it is licensed as a small public service vehicle and carries more than six passengers and a driver, then it is illegal. He is liable to prosecution and drives it at his own risk.

Is the Minister further aware that it is a very common practice in this country to use the minibus, which is, in fact, licensed as a small public service vehicle, to carry many more passengers than six and that insurance companies have given ample insurance cover for that purpose? Will the Minister try to get this matter regulated some way in order to avoid further prosecutions?

It is illegal to do what the Deputy has said is common practice.

The Minister knows the local authorities are doing it.

It is still illegal.
