Mr. Ryan

asked the Minister for Justice whether, having regard to the fact that the practice referred to by him in a reply of 28th November last relating to public fireworks displays appears to be at variance with the statutory provisions, he will introduce legislation to bring the law and practice into line.

I am not aware that the position is as stated in the question. If the Deputy is referring to Section 80 of the Explosives Act, 1875, I would point out that the prohibition is not expressed to relate simply to the use of fireworks in a public place but to their use in "any highway, street, thoroughfare, or public place". I am advised that the expression "public place" in this context means public place of a similar kind.

Am I to understand that the Minister is aware of only one statutory reference? If I draw the Minister's attention to four other statutory prohibitions, will he introduce the necessary legislation to ensure that he does not endorse a practice which is contrary to legislation?

The Deputy does not understand the position.

The Deputy obviously understands it better than the Minister.
