Written Answers. - Council of Europe Recommendations.

159.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 442 on the Hague Conventions relating to the international sale of goods, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and whether the Government are prepared to accede to these conventions.

The question of this country's becoming a party to the Convention relating to a Uniform Law on the International Sale of Goods and the Convention relating to a Uniform Law on the Formation of Contracts for the International Sale of Goods is still under consideration.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 443 on the draft European Convention on foreign money liabilities, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

The Recommendation has been referred by the Committee of Ministers to the Committee on Legal Co-operation of the Council of Europe and the matter will therefore come before the Committee of Ministers again for further consideration. Accordingly it is not possible to state the Government's attitude to the matter at this stage.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 431 on the economic development of Turkey, which was adopted by the Consultative Assembly of the Council of Europe on 30th September 1965; and what action the Government have taken, or contemplate taking, on it.

The Government is entirely sympathetic to the Recommendation that member Governments of the Council of Europe should, where practicable, pay particular attention to the development problems of Turkey.

The granting of Governmental credits and sharing in the consolidation of the external debt of developing countries, which are the forms of aid to Turkey specified in the Recommendation, do not come within the scope of this country's development aid programme. Ireland, however, does participate in the provision of multilateral assistance to Turkey through the United Nations Specialised Agencies to which the Government make voluntary contributions each year. The Recommendation will be borne in mind in connection with a review of this country's development aid programme which is at present being undertaken.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 425 on the general policy of the Council of Europe, which was adopted by the Consultative Assembly of the Council of Europe on 28th September, 1965; and what action the Government have taken, or contemplate taking, on it.

Recommendation No. 425 is still under consideration in the Committee of Ministers and accordingly it is not possible at this stage to state what the attitude of the Government will be.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 436 on fresh water pollution control in Europe, which was adopted by the Consultative Assembly of the Council of Europe on 1st October, 1965; and what action the Government have taken, or contemplate taking, on it.

The Recommendation is still under consideration in the Committee of Ministers and accordingly it is not possible at this stage to state what the attitude of the Government will be.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 426 on the creation of a regional system for the settlement of disputes among member States of the Council of Europe, which was adopted by the Consultative Assembly of the Council of Europe on 28th September, 1965; and what action the Government have taken, or contemplate taking, on it.

The question of peaceful settlement of disputes is on the agenda for the United Nations General Assembly and the Government's attitude will depend on the outcome of the discussion at the United Nations.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 435 in reply to the Thirteenth Report on the activities of the United Nations High Commissioner for Refugees, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

This Recommendation is still under consideration in the Committee of Ministers and accordingly it is not possible at this stage to state what the attitude of the Government will be.

asked the Minister for External Affairs what is the attitude of the Government with regard to recommendation No. 445 in reply to the Ninth Progress Report of the Council of Europe Special Representative for National Refugees and OverPopulation, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

The Recommendation is still under consideration in the Committee of Ministers and, accordingly, it is not possible at this stage to state what the Government's attitude will be.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 434 on the granting of the right of asylum to European refugees, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

A Draft Declaration on the Right of Asylum is under examination by the General Assembly of the United Nations. The Government's attitude with regard to the Council of Europe Recommendation will depend on the outcome of the discussion at the United Nations.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 441 on the ratification of the European Code of Social Security and Protocol thereto, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

Existing legislation precludes this country from signing or ratifying the European Code of Social Security and the Protocol thereto.

asked the Minister for External Affairs what is the attitude of the Government with regard to Recommendation No. 438 on the First Council of Europe programme on Public Health, which was adopted by the Consultative Assembly of the Council of Europe on 1st October 1965; and what action the Government have taken, or contemplate taking, on it.

The recommendation is still under consideration by the Minister for Health and accordingly it is not possible, at this stage, to state what the attitude of the Government will be.

asked the Minister for Transport and Power what is the attitude of the Government with regard to Recommendation No. 427 in reply to the Report of the Fifth Session of the European Civil Aviation Conference, which was adopted by the Consultative Assembly of the Council of Europe on 29th September 1965; and what action the Government have taken, or contemplate taking, on it.

In principle, I am in favour of the holding of a symposium, as recommended by the Consultative Assembly of the Council of Europe, on the question of greater co-operation between European Governments, aircraft manufacturers and airlines. However the matter is still under consideration by the Committee of Ministers of the Council of Europe. Any action to be taken by the Government will depend on the outcome of this examination.

asked the Minister for Local Government what is the attitude of the Government with regard to Recommendation No. 432 on recent developments in international exchanges, which was adopted by the Consultative Assembly of the Council of Europe on 30th September 1965; and what action the Government have taken, or contemplate taking, on it.

I understand that consideration of Recommendation No. 432 of the Consultative Assembly of the Council of Europe by the Committee of Ministers' Deputies has not been finalised. In the circumstances, any formulation of Government policy or other action in the matter would be premature.
