asked the Minister for Local Government whose responsibility it is to clean and maintain the burn on the upper side of the town of Raphoe, County Donegal, and to repair and improve the bridge spanning this burn between Meetinghouse Street and the Diamond; and if in view of the serious flooding recently he will direct that this much-needed work be carried out without further delay.

The primary responsibility to keep the burn referred to by the Deputy free from nuisance rests with the riparian owners. The local authority has power under section 49 of the Local Government (Sanitary Services) Act, 1948, to take such steps as are reasonably necessary to prevent injury being caused to public health or the amenities of any locality by reason of obstructions in any river or watercourse. Responsibility for repair or improvement of the bridge mentioned rests with the county council as road authority.

I am informed by the county council that no public health nuisance exists in relation to the burn and that the bridge is adequate for its purpose.
