Vol. 233 No. 9

Ceisteanna—Questions. Oral Answers. - Occupational Injuries Benefit.

63.

asked the Minister for Social Welfare whether incapacity for work resulting from personal injury sustained in a traffic accident on a worker's direct journey home from his place of employment is eligible for occupational injuries benefit.

The answer is in the affirmative, provided the worker was a passenger in a vehicle, operated by or on behalf of his employer, which was not being operated in the ordinary course of a public transport service.

May I take it that a person riding a bicycle would not be covered, although under the much abused workmen's compensation system, such a person proceeding from his place of employment homeward would have been covered?

Only in a case where the transport is supplied by or on behalf of his employers. Maybe the employer bought the bicycle. I would not like to give a decision in a specific case.

Do I understand the Minister to say that the person would be covered if he was travelling in a public service vehicle?

He is covered only if the transport is provided by or on behalf of the employers.
