asked the Minister for Local Government if a city or county manager having refused planning permission under the Local Government (Planning and Development) Act, 1963, is empowered subsequently to refuse to grant permission if directed to do so by the local authority concerned under section 4 of the City and County Management Act, 1955.

A direction under section 4 of the City and County Management (Amendment) Act, 1955, to grant a planning permission may not be given on an application in respect of which a decision has already been made and where the application is therefore not before the planning authority. In the case of a current application, if a direction is given to grant a permission for development which would contravene materially the development plan the manager would be precluded from granting the permission unless the consent of the Minister were obtained.
