asked the Minister for Justice if he will introduce legislation to amend the Rent Restrictions (Amendment) Act, 1967, so as to provide that the lessee of a controlled dwelling which he holds under a building or proprietary lease, can assign same without the consent of the lessor unless there is a specific covenant in such lease so requiring.

Mr. O'Malley

asked the Minister for Justice if he is aware that section 10 (3) of the Rent Restrictions (Amendment) Act, 1967, has been construed as applying to long leases of houses occupied by the lessees thereof and subject only to a ground rent; and that as a result a great many assignments may be invalid; and if he will introduce a Bill to clarify and, if necessary, rectify the position.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 16 and 17 together.

I am aware of the difficulty to which these questions refer. A Bill is at present being drafted, arising out of the first Report of the Landlord and Tenant Commission, which deals with occupational tenancies. An amendment of the Rent Restrictions Acts covering the point is included in that Bill.
