Vol. 241 No. 7

Ceisteanna — Questions. Oral Answers. - Dublin Planning Permission.

24.

asked the Minister for Local Government if he will state regarding Nos. 1, 2, 18 and 19 Hume Street and 44, 45, 46, 47 and 48 St. Stephen's Green, Dublin in respect of which of these buildings outline planning permission was granted prior to the preparation of the draft plan; if the person, persons or company, to whom outline permission was given, were the owners of these buildings; whether the granting of outline permission entitles the owners of the buildings, or anyone subsequently acquiring ownership, to compensation; and, if so, on what basis such compensation must be calculated.

The answer to the first part of the question is Nos. 46/49 St. Stephen's Green and No. 1 Hume Street. As regards the second part of the question an applicant for planning permission to a planning authority or to me on appeal does not have to prove ownership to me.

As regards the remainder of the question the payment of compensation is governed by conditions which are set out in Part VI of the Local Government (Planning and Development) Act, 1963. I may say, however, that the question of whether compensation is payable in any particular case is a matter to be determined under the relevant provisions of the Act.

Would the Minister say whether in his view any question of compensation arises in these cases?

Permission has been granted in this case.
