asked the Minister for Health if any of the counties comprising the Midland Health Region has failed to designate its dispensary residences for the purpose of transferring them to the Midland Health Board; and, if so, which counties.

On 1st April, 1971, dispensary residences in all health board areas became vested in health boards under paragraph (a) of subsection (1) of section 36 of the Health Act, 1970. The paragraph applies to property solely used for health purposes and as dispensary residences are clearly within that category, the question of designation under paragraph (b) of the subsection did not arise.

Can the Minister say if there has been any suggestion to the contrary in respect of dispensary residences? It would appear to me that they are primarily places of residence and that consequently they fall under paragraph (b) of that section?

The legal advisers have advised me that section (a) covers dispensary residences. I do not think anybody is questioning that.

Westmeath County Council will be questioning it and Longford County Council have not made any designation and do not propose to make any designation. They propose to retain dispensary residences for the ratepayers who built them.
