Foreshore in the Sandymount area is not State-owned and consequently licences or leases or transfers in respect of it under the Foreshore Act, 1933 are not required from me. Sections 10 and 13 of the Act govern my functions in regard to such foreshore. My approval is required under section 10 to plans and specifications for the erection on it of any building, pier, wall or other permanent structure and I am obliged under the Act to grant such approval unless the proposed structure is likely to cause an obstruction to navigation or fishing. Since 1934, 11 such approvals have been given in respect of the foreshore in the Sandymount, Merrion and Ringsend areas.
Under section 13 of the Act the deposit of material on foreshore is prohibited without my consent. Eight such consents have been given since 1937 in respect of the same area, mainly for reclamation purposes.
