asked the Minister for Local Government if he is aware that Dublin Corporation refuse to collect all the garbage put out each week by business premises; and if, in the interests of the environment, he will ensure that all garbage presented in the normal way will be cleared by the local authority concerned.

I would refer the Deputy to the reply given to his question on this subject on 7th February, 1974 in which it was pointed out that the basis on which Dublin Corporation collect garbage in their areas is a matter for them, having due regard to their statutory responsibilities.

Might I ask the Minister are there no national regulations under which local authorities or health authorities, or whatever authorities are in charge, will make sure that whatever garbage is put out is collected? Surely there should be a statutory obligation on them to do this. If these bins are going to be left out from week to week by people in trade and business and in the food business, surely they will be a health hazard to the public in general?

Section 48 of the Health (Amendment) Act, 1907 provides that if a sanitary authority are required by the owner or occupier of any premises to remove any trade refuse, other than sludge, they shall do so and the owner or occupier must make a reasonable payment for the service, the sum to be set, in any case of dispute, by order of a court of summary jurisdiction. I have no function in the matter whatever.

That is the information I wanted. I can pass that on.
