asked the Minister for Justice the number of (a) charges and (b) convictions since 1970 under section 52 of the Offences Against the State Act, 1939, and the date of the first conviction; and if he is satisfied that the enforcement of this section does not contravene any article of the European Convention on Human Rights.

Since 1970, 48 persons have been charged under section 52 of the Offences against the State Act, 1939, and 45 of these were convicted. The date of the first conviction was 27th February, 1974.

As regards the last part of the question, the Deputy will appreciate that the matter he raises is one involving the interpretation of an international Convention. I have no standing in regard to the interpretation of such a Convention, or any other aspect of international law, any more than I have in relation to the interpretation of our domestic law, and any expression of opinion on the matter by me would be both pointless and inappropriate.
