asked the Minister for Lands whether the Land Commission sets land by private treaty without first resorting to public auction or public tender; and if he will make a statement on the matter.

Cavan): Current policy provides for the letting of Land Commission lands by public auction. This is accepted as being the fairest method that can be devised and the one least likely to give cause for complaints. The Land Commission have, however, certain discretion in the matter and, where exceptional circumstances exist, may make lettings by private treaty.

Would the Minister indicate in respect of exceptional circumstances what is the instance of lettings in that regard?

(Cavan): Few and far between. The exceptional circumstances would usually be local agitation or trespass or taking forcible entry of land and so on if there is non-co-operation in a locality.
