asked the Minister for Transport and Power if he has received any applications for the reclamation of land in the Dublin Bay area for the erection of an oil refinery; and, if so, when he is likely to make a decision on the matter.

On 9th October, 1972, the Dublin Port and Docks Board applied for a harbour works order to authorise them to reclaim an area of foreshore in the vicinity of the Poolbeg generating station to provide a site for an oil refinery and tank farm.

The House was informed on 26th October, 1972, in reply to Dáil questions, that no action on the making of a harbour works order would be taken until after a decision had been taken on the relevant planning application. The Dublin Port and Docks Board were similarly advised on 30th October, 1972.

When is a decision likely in view of recent developments regarding an oil refinery?

A decision will be taken after a decision on the planning application.

I do feel that a harbour works order must be made before planning permission can be given. Permission cannot be given for something that does not exist.

I said that planning permission for the harbour works order would not be made.

In answer to questions here, the Minister for Local Government said that he would base his decision purely on planning grounds.

Has the Minister any idea when the Minister for Local Government will make a decision on the planning application?
