asked the Minister for Social Welfare if he is aware that mothers who give birth before the expected date of confinement are refused payment of the full 12 weeks' maternity benefit; and if intends taking steps to rectify this matter.

The legislation governing the payment of maternity allowance provides for a weekly payment for a period beginning with the sixth week before the end of the expected week of confinement and ending six weeks after the week in which the confinement occurs. The expected date of confinement is certified by the claimant's doctor. If the confinement occurs earlier than the date certified by the doctor the claimant may receive payment for less than the 12 weeks, but if it occurs after that date the allowance may be payable for more than 12 weeks. Payment is, however, always made for the full six weeks after confinement provided the mother does not resume employment. Any change in these provisions would require legislation.
