asked the Minister for Social Welfare the reasons disability benefit has not been paid to a person (details supplied) in County Waterford, while awaiting a decision on his occupational injuries claim.

The person concerned was paid injury benefit from 26 April 1978 to 24 October 1978, when he ceased to be entitled to such payment at the end of the statutory 26 weeks' period for which payment is allowed. He was then paid disability benefit from 25 October 1978 to 6 March 1979 when he resumed work.

He again submitted medical evidence of incapacity from 31 March 1979 and was paid disability benefit up to 6 September 1979. No further medical evidence was submitted until 24 October 1979 when certificates indicating continuing incapacity up to 19 October were received in my Department. Payment of disability benefit from 7 September to 19 October 1979 has now been issued to him.

Arrangements are being made to have him examined by a medical referee in the near future with a view to determining his title to disablement benefit under the Occupational Injuries Act in respect of his occupational accident.
