asked the Minister for Social Welfare the reason disability benefit is not being paid to a person (details supplied) in County Monaghan who is submitting medical evidence of unfitness for work.

The person concerned claimed and was paid disability benefit from 23 June 1977 to 27 October 1979. Benefit was disallowed from 29 October 1979 on the grounds that the claimant failed to prove that he was incapable of work. He appealed against this decision and his case was referred to an appeals officer who, following an oral hearing of the case, upheld the decision to disallow benefit.

The appeals officer's decision is final and conclusive and may be altered only in the light of new facts or new evidence submitted since the date of his decision. No new facts or evidence have been submitted which would warrant a review of the appeals officer's decision.

I wish to give notice that I intend to raise on the Adjournment tonight the question of giving a grant for a gymnasium in the Presentation College at Headford, County Galway.
