176.

asked the Minister for Labour: (1) the number of administrative tribunals operating within his Department; (2) the number of such tribunals operating in bodies for which he is responsible; (3) the type of each tribunal; (4) the legislation under which each tribunal operates; and (5) the number of appeals to each tribunal and the number upheld in each of the past five years.

(1) There are two administrative tribunals operating within the Department of Labour, namely the Employment Appeals Tribunal and the Levy Appeal Tribunal. In addition, the Labour Court has certain appellate functions—but as these represent only a fraction of the work of the court they are not regarded as coming within the scope of the question.

(2) There are no tribunals operating in any body for which the Minister for Labour is responsible.

(3) Both the Employment Appeals Tribunal and the Levy Appeal Tribunal are independent bodies which have been assigned specific functions in relation to the determination of appeals under different legislative provisions. They consist of a chairman and vice-chairman with legal qualifications who are appointed by the Minister for Labour together with panels of ordinary members who are appointed on the nominations of the Irish Congress of Trade Unions and of employer organisations.

(4) and (5) Details of the relevant legislation and of the appeals dealt with are set out in the form of a tabular statement.

There are no administrative tribunals operating within my Department or in bodies for which I have responsibility.

There is no administrative tribunal operating within my Department.

There are no administrative tribunals operating within my Department or in any of the bodies for which I am responsible.
