Vol. 331 No. 7

Written Answers. - County Wexford Pension Application.

696.

(Wexford) asked the Minister for Defence when a pension at the full rate will be paid to a person (details supplied) in County Wexford who suffered severe injury while in the Defence Forces.

The person referred to by the Deputy was awarded a disability pension under the Army Pensions Acts in respect of the injury in question. He, subsequently, received a lump sum payment for the same injury in settlement of civil claim. The Army Pensions Acts provide that where compensation is received after the award of any such pension, the award may be reviewed and, having regard to the amount of such compensation, the pension may be either terminated or reduced. As the annual value of the compensation in this case, assessed on an actuarial basis, exceeded the appropriate rate of pension under the Army Pensions Acts, payment of pension has been withheld. The question of resumption of payment will be considered if and when the annual rate of pension, appropriate to the degree of disablement, exceeds the annual value of the compensation awarded.
