asked the Minister for Social Welfare the reason unemployment benefit has not been paid to a person (details supplied) in County Laois.

The person concerned was not qualified for unemployment benefit at the date of his claim as according to the Department's records he did not fulfil the statutory contribution conditions in the relevant contribution period from April 1979 to April 1980.

Inquiries were made in the matter and on the basis of evidence of employment furnished by the person concerned his claim for unemployment benefit at the weekly rate of £49.80 was allowed. All arrears due to him were paid on 10 December 1981 and further payments of unemployment benefit will be paid to him as weekly payments fall due.

680.

asked the Minister for Social Welfare the reason pay-related and disability benefits which are due in respect of the period 4 September 1980 to 8 November 1981 have not been paid to a person (details supplied) in County Offaly.

The person concerned claimed disability benefit from 17 September 1980 and was paid from 20 September 1980, fourth day of incapacity, to 7 October 1981, after which date he resumed work.

The pay related benefit element of the claim could not be dealt with at the time as details of the claimant's reckonable earnings in the relevant tax year were not available. On completion of the necessary inquiries payment of all pay-related benefit due on the claim has been made. This benefit was included in the cheques which issued weekly from 4 June 1981 and a final adjusting payment was made on 11 December 1981.

asked the Minister for Social Welfare the reason disability benefit has not been paid to a person (details supplied) in County Offaly.

The person concerned claimed disability benefit from 15 May 1981. As she had been employed in Great Britain from July 1978 to March 1980 it was necessary to approach the Department of Health and Social Security to obtain details of her British insurance record before payment of benefit could be authorised. On completion of the inquiries all disability benefit due to 12 December 1981 was issued.

asked the Minister for Social Welfare the reason a widow's pension has not been granted to a person (details supplied) in County Offaly.

The person concerned originally claimed a non-contributory widow's pension in November 1974. Following investigation it was decided that she was not entitled to a pension on the basis of means derived from a holding and some capital. She appealed against this decision but her appeal was disallowed by an appeals officer.

She subsequently applied for a contributory widow's pension on the basis of her own insurance. The claim was refused on the grounds that she did not satisfy the statutory qualifying contributions for the award of such a pension. She appealed against this decision and the papers have been referred to an appeals officer for determination. She will be notified of the decision of the appeals officer as soon as it becomes available.

asked the Minister for Social Welfare when a contributory old age pension will be granted to a person (details supplied) in County Offaly.

There is no record of receipt in my Department of a claim for a contributory old age pension from the person concerned. A claim form has been issued to him and his entitlement to the pension will be considered when the completed form is returned.

684.

asked the Minister for Social Welfare the reason a new children's allowance book has not been issued to a person (details supplied) in County Kildare.

A supplementary children's allowance book at the rate of £9.00 per month payable with effect from August 1981 to June 1982 was issued to the person concerned in respect of his sixteen year old daughter, Martina, but was not received.

However, on receipt of a letter from the claimant indicating non-receipt of the book in question a replacement book with orders cashable from October 1981 to June 1982 was issued on 2 December 1981 and a payable order for £18.00 in respect of arrears due for the months of August and September 1981 issued on 9 December 1981.

asked the Minister for Social Welfare the reason injury benefit has not been paid to a person (details supplied) in County Offaly.

The person concerned claimed occupational injury benefit in respect of an accident at work on 13 November 1981. Pending inquiries regarding the nature and origin of his incapacity he was paid disability benefit on an interim basis from 17 November 1981, fourth day of incapacity.

On completion of the inquiries his claim to injury benefit was allowed from 13 November 1981. Payment of all injury benefit and pay-related benefit due to 11 December 1981, date of the latest medical evidence received, has now been made.

asked the Minister for Social Welfare when a living alone allowance, which is due since May 1981, and a free electricity allowance will be provided for a person (details supplied) in County Leitrim.

The person concerned is in receipt of retirement pension since 19 July 1979. He submitted a claim for living alone allowance on 24 November 1981 and this has been approved with effect from 21 May 1981. A supplementary book containing orders for payment from 1 October 1981 has been issued to the designated post office and he has been notified accordingly. The arrears will be sent to him by means of a payable order. He has been in receipt of the free electricity allowance since his application was approved in May 1980.

asked the Minister for Social Welfare if an old age pension will be paid to a person (details supplied) in County Leitrim.

The person concerned has been in receipt of a non-contributory old age pension at a reduced rate since 1976. A claim made by him for an increase in pension was submitted recently to an appeals officer who determined that an increase was not appropriate. The person is currently in receipt of pension at the weekly rate of £20.35.

asked the Minister for Social Welfare if a person (details supplied) in County Cavan is entitled to unemployment benefit in view of her social insurance contribution in the United Kingdom and the Republic of Ireland; and, if so, when she will be paid.

It has not been possible to trace a claim to unemployment benefit in respect of the person concerned from the particulars furnished by the Deputy.

Arrangements were made for an officer of my Department to call on the person concerned and in this connection she was interviewed on Saturday, 11 December 1981 at her home address. The person concerned has been advised to register as unemployed at a local office of the Department and steps are being taken to obtain details of her UK contribution record from the British authorities to enable her combined British and Irish contribution records to be established.

As soon as the necessary inquiries are completed her claim to unemployment benefit will be dealt with.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Donegal.

There is no trace of the receipt in my Department of the papers relating to a claim for disability benefit in respect of the person concerned which are alleged to have been forwarded by the British Department of Health and Social Security. As, however, he is qualified for payment on his Irish insurance record it has been decided to pay him disability benefit at the appropriate personal rate. On the return of the application form for an increase of benefit in respect of dependants which issued to him recently payment, if any, due in respect of dependants will be made.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Donegal.

The person concerned claimed disability benefit from 27 November 1980 and was paid to 14 May 1981 after which date payment was refused following examination by a medical referee who considered her capable of work. She was notified of the decision and of her right to appeal if dissatisfied. No appeal was received but she continued to submit medical certificates up to 28 November 1981.

She then claimed maternity allowance in respect of a confinement expected on 4 January 1982 and payment of the allowance has been made weekly since 30 November 1981.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Donegal.

Following the completion of extensive inquiries a deciding officer assessed the person concerned with means of £5.00 weekly derived from self-employment with effect from 10 September 1981. The person concerned is a postal applicant and arrangements have been made to issue an order for encashment at his local post office paying all arrears of unemployment assistance due to him this week. Further weekly payments at £42.05 being the maximum rate £47.05 less means £5.00 will be made as they become due.

asked the Minister for Social Welfare when the payment of disability benefit will be restored to a person (details supplied) in County Donegal.

The person concerned has been paid all disability benefit due to 19 December 1981. Payment will continue to issue in future at regular weekly intervals.

asked the Minister for Social Welfare the reason for the delay in paying disability benefit to a person (details supplied) in County Cork.

There is no trace in my Department of the receipt of a recent claim to disability benefit from the person concerned. However, it has been ascertained from his employers that he was absent from work due to illness from 3 August to 4 October 1981 inclusive. Accordingly all benefit due, at the maximum appropriate rate, has been paid to him in respect of the period 6 August, fourth day of incapacity, to 3 October 1981, after which date he resumed work.

asked the Minister for Social Welfare the reason for the delay in paying disability benefit to a person (details supplied) in County Cork.

The person concerned was in receipt of disability benefit from 29 September 1977 to 21 November 1981 when payment was suspended temporarily pending a review of her entitlement to continuing benefit. Payment has since been resumed and all benefit due to 19 December has been issued.

asked the Minister for Social Welfare the reason for the delay in paying disability benefit to a person (details supplied) in County Cork.

The person concerned claimed disability benefit from 31 August 1981 and has been paid all disability benefit due from 3 September 1981, fourth day of incapacity, to 12 October 1981, after which date he was certified fit to resume work.

The delay in payment of benefit in this case was due to the fact that the claimant quoted an incorrect RSI number on the medical evidence submitted in support of his claim. It was necessary to ascertain the correct number before his entitlement to benefit could be established.

asked the Minister for Social Welfare when arrears of injury benefit will be paid to a person (details supplied) in County Donegal.

There is no record of the receipt in my Department of a claim for benefit from the person concerned. The employers were contacted and they confirmed that he was absent from work owing to illness from 9 February to 20 February 1981. Payment of disability benefit has accordingly been allowed from 12 February and a cheque paying all disability benefit due at the maximum appropriate rate has been made to 20 February 1981.

asked the Minister for Social Welfare the amount of the non-contributory old age pension being paid to a person (details supplied) in County Tipperary; why a pension at the full rate is not being paid; in the event that she believes that this person is not entitled to a full pension, the reason; and if she will give details, if appropriate, of the other means it is alleged this pensioner has.

The person concerned is in receipt of pension of £12.75 a week which includes the allowance payable to a pensioner aged eighty years or over.

An appeals officer has determined that the pensioner is not entitled to pension at the maximum rate as his means, consisting of the weekly value of a holding and capital preclude him from receipt of pension at a rate higher than that in payment.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Tipperary.

The person concerned is an applicant for unemployment benefit and following the completion of inquiries to ascertain the reason for termination of his employment, payment of unemployment benefit at the weekly rate of £66.20 was authorised.

He is a postal applicant and an order for encashment at his local post office paying all arrears due issued to him during the week commencing 24 November 1981.

Weekly payments of unemployment benefit will continue as they fall due.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Tipperary.

The person concerned claimed disability benefit from 12 October 1981. He is not qualified for payment as he has not the required minimum of 26 contributions paid or credited in the governing 1979-80 contribution year.

It has, however, been ascertained that he was employed in Great Britain for a number of years. The British Department of Health and Social Security has accordingly been requested to furnish, as a matter or urgency, details of his British insurance record. If, on receipt of this record, he is qualified for benefit, payment will be made immediately.

asked the Minister for Social Welfare if she will make arrangements to have unemployment benefit paid to a person (details supplied) in County Offaly who applied to Birr employment exchange last September and who is still awaiting a decision on the matter.

The person concerned is an applicant for unemployment assistance as he does not fulfil the statutory contribution conditions for receipt of unemployment benefit.

Following the completion of extensive inquiries in this case a deciding officer of my Department disallowed his claim for unemployment assistance on the grounds that the person concerned is not available for work.

It is open to him to appeal against the disallowance of his claim and to have the case determined by an appeals officer. A form for this purpose may be obtained at his local office.

asked the Minister for Social Welfare when a decision will be given on an application for a free electricity allowance by a person (details supplied) in County Donegal.

The application for free electricity allowance from the person concerned has been approved from the October-November 1981 billing period onwards. The ESB have been instructed to apply the allowance to her electricity account from that period.

asked the Minister for Social Welfare when a free electricity allowance will be granted to a person (details supplied) in County Donegal.

From the information available to my Department the person concerned is in receipt of a British invalidity pension which in not one of the specified pensions or allowances which would enable him to qualify for a free electricity allowance.

(Wexford) asked the Minister for Social Welfare when she will pay disability benefit to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 26 August 1981 and was paid from 29 August, fourth day of incapacity, at the maximum appropriate rate. All payment due has been made to 17 October 1981, after which date he was certified fit to resume work.

(Wexford) asked the Minister for Social Welfare when she will pay disability benefit to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 22 August 1981 and was paid at the maximum appropriate rate from 26 August, fourth day of incapacity. Payment was made on receipt of medical evidence of incapacity and all benefit due to 23 October 1981, after which date he was certified fit to resume work, has issued.

(Wexford) asked the Minister for Social Welfare if she will pay unemployment assistance in respect of 14 weeks to a person (details supplied) in County Wexford.

The person concerned is not entitled to unemployment assistance, which she claimed from 9 June 1981, because a deciding officer assessed her with means of £28.00 weekly and, as this amount exceeds the maximum rate of unemployment assistance payable in her case, unemployment assistance is not payable to her. The person concerned did not appeal against the decision of the deciding officer, who disqualified her claim on the 30 September 1981.

706.

(Wexford) asked the Minister for Social Welfare if she will grant unemployment assistance to a person (details supplied) in County Wexford.

The claim to unemployment assistance of the person concerned was disallowed by a deciding officer on the grounds that his means derived from self employment exceeded the statutory limit. The person concerned appealed against the disallowance and his case has been referred to an appeals officer for determination. His application for unemployment assistance will be reviewed in the light of the appeals officer's decision in the case.

707.

asked the Minister for Social Welfare why a person (details supplied) in County Dublin has not received disability benefit in respect of the period 29 August to 4 October 1981, in spite of having twice submitted doctor's certificates and a statement from his employer; why the person was forced to endure considerable hardship during this period; and if she will arrange that the person now receives benefit.

The person concerned claimed disability benefit from 31 August 1981 to 3 October, after which date he was certified fit to resume work. Payment issued at the time to an incorrect address. On receipt of notification of the correct address, replacement cheques were issued.

asked the Minister for Social Welfare when a pension book will be issued to a person (details supplied) in County Galway.

A replacement non-contributory old age pension order book, payable from 2 October 1981 at the rate of £26.35 was issued to the person concerned on 2 December 1981 following notification that he had not received his renewal book, which was issued to the nominated post office in September 1981.

asked the Minister for Social Welfare if she will arrange for the immediate payment of disability benefit to a person (details supplied) in County Galway.

The person concerned claimed disability benefit from 21 September 1981 and has been paid all benefit due from 24 September 1981, fourth day of incapacity, to 12 December 1981, date of the latest medical evidence received, at the maximum appropriate rate. As he was in receipt of supplementary welfare allowance during part of the period of his claim, the amount of the allowance paid to him was withheld from arrears of disability benefit due and refunded to the Western Health Board.

asked the Minister for Social Welfare if she will arrange for the immediate payment of a children's allowance to a person (details supplied) in County Roscommon.

A claim for an extended children's allowance in respect of a child over 16 years of age was received from the person concerned on 2 November 1981. The allowance was extended to February 1982, when the child in question will reach 18 years of age, and an allowance book at the rate of £9.00 a month, with orders cashable from November 1981 to February 1982, issued on 14 December 1981. A payable order, value £36.00, in respect of the arrears due has also issued.

asked the Minister for Social Welfare if she will arrange for the immediate payment of a children's allowance to a person (details supplied) in County Roscommon.

The person in question is at present in receipt of children's allowances at the rate of £51.00 per month in respect of five qualified children under the age of 16 years and one over 16 years.

A continuation of children's allowance was awarded on educational grounds in respect of her son from February 1980, when he attained the age of 16 years, to June 1981, in accordance with the school certificate furnished. On receipt of a further school certificate the award was extended to January 1982, when the child in question will reach the age of 18 years.

An allowance book with orders cashable for the period November 1981 to January 1982 issued on 14 December 1981 and a payable order for £36.00 in respect of arrears due to October 1981 will issue on 16 December 1981.

712.

(Limerick West) asked the Minister for Social Welfare when a person (details supplied) in County Limerick will be paid unemployment and pay-related benefit.

The person concerned claimed unemployment benefit from 2 November 1981, but, as he was in receipt of holiday pay from his employer until 8 November, payment of benefit was allowed from 9 November 1981.

Flat rate unemployment benefit at the weekly rate of £71.75 was authorised and, as the person concerned is a postal applicant, an order for encashment at his local post office was issued to him during the week commencing 30 November 1981 paying all arrears of flat rate unemployment benefit less the amount of supplementary welfare allowance which had been advanced to him. He is also entitled to pay-related benefit at £39.16 weekly and arrangements have been made to pay all pay-related arrears this week. Further combined payment of unemployment benefit and pay-related benefit, totalling £110.91, will be made as weekly payments become due.

asked the Minister for Social Welfare why disability benefit which is due to a person (details supplied) in County Galway who has been sick from 30 September to 2 November 1981 has not yet been paid; and when it is proposed to pay this benefit.

The person concerned claimed disability benefit from 29 September 1981 and was paid from 2 October, fourth day of incapacity, at the maximum appropriate rate. All payment due was made to 31 October, after which date he was certified fit to resume work. A cheque in respect of the period 2 October to 31 October issued on 11 December.

The delay in payment was due to the fact that he was not qualified for payment on his insurance record for 1979-80, the contribution year governing his claim, and it was necessary to obtain details of his record for 1978-79 before his claim could be authorised. When details of his earnings in the 1979-80 tax year are available, pay-related benefit, if due, will issue.

714.

(Wexford) asked the Minister for Social Welfare when she will pay unemployment assistance to a person (details supplied) in County Wexford.

It has not been possible to identify the applicant for unemployment assistance from the details supplied. If the Deputy will furnish me with the full name of the person and the address of the local office at which she claimed unemployment assistance, I will have the matter further investigated.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 22 June 1981 and has been paid at the maximum appropriate rate from 25 June, fourth day of incapacity. Payment of all benefit due has issued to 14 December 1981.

asked the Minister for Social Welfare when unemployment assistance at the full rate will be paid to a person (details supplied) in County Wexford.

The person concerned has applied for reassessment of means and his case is presently being investigated by a social welfare officer of my Department. When the necessary inquiries are finalised the assessment of his means for the purposes of his claim to unemployment assistance will be reviewed by a deciding officer and the person concerned will be advised of the outcome.

asked the Minister for Social Welfare the reason for the delay in paying unemployment assistance to a person (details supplied) in County Carlow.

The entitlement of the person concerned to unemployment assistance could not be determined until inquiries to assess his means were completed. Investigations in the case were recently finalised and he has been assessed with nil means.

The person concerned is entitled to unemployment assistance at £61.00 weekly and, as he is a postal applicant, an order for encashment at his local post office paying all arrears, less the amount of supplementary welfare allowance advanced to him, issued to him last week. Payment of unemployment assistance will continue to be made as weekly payments fall due.

asked the Minister for Social Welfare when an invalidity pension will be paid to a person (details supplied) in County Tipperary who has been receiving a disability pension for many years because of partial blindness.

A form on which to claim invalidity pension has been issued to the person concerned for completion and on its return arrangements will be made to transfer him to invalidity pension.

asked the Minister for Social Welfare if her Department will resolve the irregular payments of disability benefit which are being paid to a person (details supplied) in County Tipperary; and if these payments will be brought up to date.

The person concerned has been in receipt of disability benefit since 3 February 1981 and has been paid on receipt of medical evidence. All payment due has been made to 19 December 1981. I have arranged that in future he will be paid each week, but monthly certificates only will be required.

asked the Minister for Social Welfare the reason a children's allowance has not been paid to a person (details supplied) in County Tipperary; and when it will be paid.

An extended children's allowance, on educational grounds, was paid to the person concerned in respect of his 17 year old son from January 1981 to June 1981. A further extension of the allowance has been awarded, in respect of an apprenticeship from July 1981 to June 1982.

An allowance book at the rate of £6.00 per month, with orders cashable from October 1981 to June 1982, was issued on 11 December 1981 and a payable order for £18.00 in respect of arrears due to September 1981 will issue on 16 December 1981.

asked the Minister for Social Welfare the reason a children's allowance has not been paid since June 1981 to a person (details supplied) in County Tipperary.

The delay in dealing with this case was due to the fact that the file relating to the claim was mislaid. The matter has now been rectified and an allowance book for his school-going son covering the period October, 1981 to June 1982 issued on 11 December 1981. A payable order covering arrears due from July 1981 will issue on 16 December 1981.

asked the Minister for Social Welfare if she will arrange to pay unemployment benefit to a person (details supplied) in County Cork who is available for work.

Inquiries to establish that the person concerned is available for work were recently completed and her claim for unemployment benefit at the weekly rate of £22.25 has been authorised. The person concerned is a postal applicant and arrangements have been made to issue an order for encashment at her local post office paying all arrears due to her this week. Further payments of unemployment benefit will be made as weekly payments fall due.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Tipperary.

As the person concerned refused to disclose his means, a deciding officer decided that he was not entitled to a qualification certificate on the grounds that he failed to show that his means did not exceed the statutory limit. The person concerned is accordingly not entitled to unemployment assistance and this decision has been conveyed to him.

asked the Minister for Social Welfare the reason unemployment benefit has not been paid to a person (details supplied) in County Kildare.

The reason that unemployment benefit has not been paid to the person concerned is that he has no contributions paid during the relevant contribution periods according to the records of my Department.

Pending the completion of inquiries he was advised to claim unemployment assistance and, as he has been assessed with nil means, payment of unemployment assistance at the weekly rate of £47.05 has been authorised.

The claimant is a postal applicant and arrangements have been made to issue an order for encashment at his local post office paying all arrears due to him this week. Further payments of unemployment assistance will be made as weekly payments become due.

asked the Minister for Social Welfare the reason disability benefit has not been paid to a person (details supplied) in County Offaly.

The person concerned claimed disability benefit from 7 September 1981, but she is not entitled to payment as she has less than the required minimum of 26 contributions paid or credited in 1979-80, the contribution year governing her claim.

asked the Minister for Social Welfare the reason a person (details supplied) in County Galway who was in receipt of unemployment assistance at the rate of £15.75 per week was disallowed assistance from July 1981.

The reason that unemployment assistance was disallowed from 12 August 1981 is that, following an investigation of the case, a deciding officer assessed the person concerned with means, derived from self-employment, which were in excess of the maximum rate of unemployment assistance payable to him. The person concerned appealed against the decision but an appeals officer upheld the means assessment in the case. The person concerned has ceased to sign as unemployed.

727.

asked the Minister for Social Welfare when the old age pension will be paid to a person (details supplied) in County Galway.

It was decided by an appeals officer on 28 October 1981 that the person concerned is not entitled to a non-contributory old age pension as he failed to establish that he fulfilled the statutory condition as to means.

As a result of a recent application by the claimant inquiries are now proceeding to ascertain whether there are any new facts or fresh evidence which would warrant a revision of the appeals officer's decision and the claimant will be notified of the outcome in due course.

728.

asked the Minister for Social Welfare if a person (details supplied) in County Galway is entitled to an increase in his unemployment assistance.

The person concerned is at present being paid unemployment assistance at the rate of £68.95, this is the maximum rate payable to a married man residing in a rural area with eight qualified children whose means are assessed at £6.00 weekly on a factual basis.

A factual assessment of his means is more advantageous to him than a notional assessment. If the person concerned is of opinion that his circumstances have changed since an appeals officer assessed him with £6.00 means from 13 August 1980, it is open to him to apply at his local office for a re-investigation of his case.

729.

asked the Minister for Social Welfare if a person (details supplied) who is on unemployment assistance will be entitled to the additional allowance at Christmas.

The provisions for a double payment in one week in the month of December 1981 do not apply to recipients of unemployment assistance. The person concerned is not, therefore, entitled to a double payment.

730.

asked the Minister for Social Welfare when a non-contributory pension at the full rate will be paid to a person (details supplied) in County Galway as she is completely dependent on the present rate of pension and has no other means.

The person concerned was awarded a widow's non-contributory pension at a reduced rate, with effect from 25 March 1977, on the basis of her means assessed on the value of a farm. Following notification in April 1978 that the farm had been transferred to her son, a report on the new circumstances was obtained. It was reported that her means were unchanged as the transfer had not been completed. She was notified of this by decision dated 8 June 1978.

She appealed against the decision. However before the case can be submitted for decision by an appeals officer it is necessary for the deed to be lodged for stamping. The local social welfare officer has reported on several occasions to date that the deed has not yet been lodged and the pensioner's means assessment cannot be revised until the deed has been lodged.

Claimant is at present in receipt of a pension of £23.95 a week. The maximum weekly rate for which she could qualify at present would be £27.55 if her means were assessed as nil.

asked the Minister for Social Welfare when disability benefit which is owed since 30 October 1981, will be paid to a person (details supplied) in County Kilkenny.

The person concerned claimed disability benefit from 2 November 1981, but he is not qualified for payment as, according to the records of my Department, he has less than the statutory minimum of 26 contributions paid or credited in the 1979-80 governing contribution year.

It has been ascertained that he was employed in Great Britain during 1979-80. He has, therefore, been requested to supply details of that employment, so that his insurance record can be obtained from the British Department of Health and Social Security. On completion of inquiries his claim will be reviewed.

asked the Minister for Social Welfare if she will arrange to have a claim for a non-contributory old age pension processed for a person (details supplied) in County Cork.

The local pensions committee have decided that the person concerned is entitled to an old age pension at the maximum rate plus an adult dependant allowance from 30 September 1981. A pension order book at the rate of £41.40 issued to the claimant on 14 December 1981 and arrears due will issue in the near future.

asked the Minister for Social Welfare if she will arrange to pay pay-related benefit to a person (details supplied) in County Cork.

The person concerned claimed disability benefit from 2 November 1981 and has been paid from 5 November, fourth day of incapacity. All disability benefit due to 8 December 1981, date of latest medical certificate received, has been paid. He is not entitled to pay-related benefit as the weekly rate of disability benefit payable is greater than his reckonable weekly earnings in 1979-80, the tax year on which his entitlement to pay-related benefit is based. According to the records of my Department he was claiming disability benefit and unemployment benefit for a total of 46 weeks in that year.

asked the Minister for Social Welfare if she will arrange to pay a non-contributory widow's pension to a person (details supplied) in County Cork.

The person concerned has been awarded a widow's non-contributory pension at the maximum rate appropriate to a widow with no qualified children and whose means are assessed as nil. A pension book with orders payable from 6 November 1981 has been issued to the designated post office for collection by her and she has been notified accordingly. Her late husband was in receipt of an old age non-contributory pension, which included an increase in respect of his wife, and this pension continued to be paid to her for six weeks after his death on 18 September 1981 i.e. from 25 September to 5 November 1981.

asked the Minister for Social Welfare if she will arrange to pay disability benefit to a person (details supplied) in County Cork.

The person concerned claimed injury benefit from 20 October 1980, in respect of an accident at work on that date, and was paid for the full statutory period of 26 weeks up to 18 April 1981. As injury benefit is not payable beyond this period his claim subsequent to that date was treated as one for disability benefit. All such benefit due to 14 December 1981 at the maximum appropriate rate has been paid, less amount of supplementary welfare allowance advanced. When details of his earnings in 1978-79 tax year are available, pay-related benefit, if due, will issue.

(Wexford) asked the Minister for Social Welfare when disability benefit in respect of the period 17 February to 31 March 1980 will be paid to a person (details supplied) in County Wexford.

The person concerned did not claim disability benefit from my Department in 1980. The Deputy's inquiry probably relates to a claim for the period 18 February 1981 to 24 March 1981. The claimant was not however entitled to payment in respect of this period as he had no paid or credited contributions in the 1979-80 year which governs payment of benefit on this claim. It is understood that he was working during the governing contribution year as a sub-contractor and accordingly was not insurably employed.

asked the Minister for Social Welfare when disability payments will be updated and paid to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 9 November 1981 and has been paid all disability benefit and pay-related benefit due to 14 December 1981 at the maximum appropriate rate. He has been quoting an incorrect RSI number on the medical certificates submitted to my Department. He has been advised to quote his correct RSI number on all future medical certificates.

asked the Minister for Social Welfare when a single women's allowance will be paid to a person (details supplied) in County Wexford.

The person concerned is not entitled to single women's allowance as a deciding officer assessed her with means in excess of the maximum rate payable in her case. She appealed against the disallowance but an appeals officer, whose decision is final, upheld the disqualification of her claim.

asked the Minister for Social Welfare when unemployment assistance will be restored to a person (details supplied) in County Wexford.

The claim to unemployment assistance of the person concerned was disallowed from 30 September 1981 by a deciding officer because he refused to disclose particulars of his means to a Social Welfare Officer who was reviewing his case. The person concerned has appealed against the disqualification of his claim and in this connection his case is being further investigated by a social welfare officer of my Department. When inquiries are finalised his claim will be referred to an appeals officer for determination.

asked the Minister for Social Welfare when an orphan's pension will be issued to a person (details supplied) in County Wexford.

The person concerned has been awarded a contributory orphan's pension with effect from 9 October 1981, the Friday following the death of the father, who was a widower. A pension book containing orders from 11 December 1981 was issued on that date to the designated post office and the guardian has been notified accordingly. Arrears of pension due from 9 October 1981 to 10 December 1981 have been paid direct to the guardian after deduction of the amount of supplementary welfare allowance which he received from that date from the South Eastern Health Board on behalf of the orphan.

asked the Minister for Social Welfare when unemployment assistance at the full rate will be paid to a person (details supplied) in County Wexford.

The person concerned applied for a re-assessment of his means, and following the completion of investigations, a deciding officer of my Department has decided that his means derived from self-employment exceed the statutory limit of £2,740.40 per annum with effect from 30 December 1981. Consequently he will not be entitled to payment of unemployment assistance after that date. If the person concerned is dissatisfied with the decision in his case it is open to him to appeal and to have his means determined by an appeals officer. A form for this purpose may be obtained at his local office.
