asked the Minister for Transport if he will instruct the Dublin Port and Docks' Board not to renege again on the unequivocal assurance it gave to his predecessor in 1969 that it will not avail itself of the loophole in the planning law, as it did when it objected to Dublin Corporation's amenity order.

At the request of the Government in May 1969 the then Minister for Transport and Power sought and was given an assurance by the Dublin Port and Docks Board that the board would not seek to take advantage of a legal technicality to circumvent the planning laws in the matter of obtaining planning permission for building development or other unexempted forms of development.

As far as I am aware the board have complied fully with the terms of the assurance given at that time.
