asked the Minister for Labour if there has been any communications or criticism from the EEC on the question of the operation of equality legislation in Ireland; and if he will make a statement on the matter.

A communication in the form of a reasoned opinion has been received from the Commission of the European Communities.

The Commission are maintaining that exclusions from the scope of the Employment Equality Act, 1977, which relate to employment as midwives and public health nurses, employment in a single sex institution providing special treatment or supervision for persons in care, e.g. employment in psychiatric hospitals and employments excluded on grounds of privacy or decency, are in conflict with the requirements of Article 2(2) of Council Directive 76/207/EEC of 9 February 1976.

The contents of the communication are under consideration in consultation with the interests involved with a view to determining a response to the Commission.
