asked the Minister for Transport whether the then Minister for Industry and Commerce announced certain Government decisions on 13 June 1969 in regard to the plans of the Dublin Port and Docks Board for reclamation in Dublin Bay, plans which are a matter of considerable interest and concern locally and which are also of great national significance; what these decisions were; and when they will be implemented.

In May 1969 the Government decided that the then Minister for Transport and Power should seek from the Dublin Port and Docks Board an assurance that:—

(a) works for which the authority of a Harbour Works Order is required will not be undertaken in future in advance of the making of the relevant order, and

(b) that the board, or their lessees or assignees, would not seek to take advantage of a legal technicality to circumvent the requirements of the planning legislation in the matter of obtaining planning permission for building development or other unexempted forms of development on reclaimed land.

It would appear from papers on file in my Department that on 13 June 1969, the then Minister for Industry and Commerce informed a meeting at Clontarf, inter alia, that in the meantime an unequivocal assurance had been obtained from the Port and Docks Board to the effect that:—

(a) the board would not in future commence work requiring the authority of a Harbour Works Order in advance of the making of the relevant Order, and

(b) that the board would not again avail itself of the loophole in the existing Planning Law.

I can confirm that the assurance in question was sought and obtained from the Dublin Port and Docks Board.
