asked the Minister for Justice whether representations made on behalf of applicants for Garda recruitment are considered by the Civil Service Commission; and whether he has the final decision on the selection of successful candidates.

Limerick East): Under the terms of the Garda Síochána (Appointments) Regulations, 1945 to 1982, applicants for appointment to the force must pass a qualifying educational examination and a competitive interview, which are conducted by the Civil Service Commissioners. The commissioners have informed me that the order of merit of candidates is determined solely on their performance at the competitive interview. Indeed, they have a ruling that any candidate at a competition held by them will be disqualified if they consider that an attempt is being made to influence their decision in his/her case.

The Garda Síochána (Appointments) Regulations provide that before appointing any candidate who has qualified for appointment as a result of the competitive interview, the Garda Commissioner has to be satisfied that the candidate fulfils other requirements which are set out in Article 4 of the Garda Síochána (Appointments) Regulations, 1945, as inserted by article 3 of the 1981 regulations.

The Minister for Justice is not involved in the selection of individual persons for appointment to the force.

asked the Minister for Justice if there is any Garda recruitment intended in 1983; and the regulations governing Garda recruitment.

Limerick East): Garda recruitment is continuing this year, 57 recruits were appointed to the force on 26 January and 45 more are due to be appointed within the next month. The total number to be recruited in 1983 will depend mainly on the funds provided in the Garda estimates, which have not yet been finalised. The regulations governing Garda recruitment are the Garda Síochána (Appointments) Regulations, 1945 to 1982.
