35.

asked the Minister for Justice the number of indictable offences heard in the courts in the State before a judge and jury in 1981.

36.

asked the Minister for Justice the number of indictable offences which remained untried at the end of 1981.

(Limerick East): A Cheann Comhairle, I propose to answer Questions Nos. 34, 35 and 36 together.

As court statistics are complied on the basis of legal years rather than calendar years I propose to reply to the Deputy's question on the basis of the statistics available for the year ended 31 July 1981 except in the case of the Special Criminal Court where figures are available for the calendar year 1981. Also, all of the courts, with the exception of the District Court, compile their statistics on the basis of cases and not offences. A case could include a number of offences.

The number of indictable offences tried summarily in the District Court in the year ended 31 July 1981 was 60,438. Figures are not available for the number of offences untried at the end of the year.

The number of indictable cases heard before a judge and jury in the Circuit Court in the year ended 31 July 1981 was 1,207 and the number of cases untried at the end of the year was 375.

The number of indictable cases heard before a judge and jury in the Central Criminal Court in the year ended 31 July 1981 was 138 and the number of cases untried at the end of the year was 59.

The number of indictable cases tried in the Special Criminal Court in the year ended 31 December 1981 was 42. The number of untried cases at the end of the year was 60.
