Written Answers. - Social Welfare Benefit.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Donegal.

The person concerned claimed unemployment benefit on 9 January 1984, and when inquiries were completed to establish that he was available for work his claim was authorised at £34.80 weekly, being the maximum rate appropriate in his case. All arrears due were paid to him last week. Further weekly payments will continue to be made as they become due.

asked the Minister for Social Welfare when a decision will be made on an appeal against the reduction in unemployment assistance of a person (details supplied) in County Galway.

Following a re-investigation of his unemployment assistance claim, the means of the person concerned were assessed at £46.20 weekly derived from capital and from the profit from his land with effect from 2 November 1983. He appealed against the decision but the papers were mislaid and the case has been referred to the appeals officer for determination as quickly as possible. His entitlement to unemployment assistance will be reviewed in the light of the appeals officer's decision.

In the meantime weekly payments of £27.40, being the appropriate maximum rate in his case of £73.60 less means £46.20, will continue to be made as they become due.

asked the Minister for Social Welfare when pay-related benefit will be paid to a person (details supplied) in County Galway.

The person concerned claimed disability benefit from 3 January 1984 and was paid to 28 January 1984, after which date he was certified fit to resume work. In addition, payment of pay-related benefit was made from 24 January 1984, 19th day of incapacity.

asked the Minister for Social Welfare if the maximum rate of social welfare benefit is being paid to a person (details supplied) in County Galway.

The person concerned is in receipt of unemployment assistance at the weekly rate of £10.10 being the appropriate maximum rate in his case of £29.40 less means £19.30 derived from income from a deed of transfer. He has been furnished with a form to apply for a review of his means and when he returns the completed form to his local office his case will be referred to a social welfare officer for further inquiries into his means. His entitlement to unemployent assistance will be reviewed in the light of the means assessed against him. In the meantime weekly payments of £10.10 will continue to be made as they become due.

asked the Minister for Social Welfare if the maximum rate of social welfare benefit is being paid to a person (details supplied) in County Galway.

The person concerned is in receipt of unemployment assistance at the weekly rate of £12.95 being the appropriate maximum rate in his case of £29.40 less means £16.45 derived from capital. Weekly payments of £12.95 will continue to be made as they become due.

asked the Minister for Social Welfare when unemployment assistance at the correct rate will be paid to a person (details supplied) in County Galway.

The person concerned is in receipt of unemployment assistance at £77.30 weekly, being the appropriate maximum rate in his case of £80.30 less means of £3.00 derived from land he occupies.

He applied on 18 January 1984 for an increase in his rate of unemployment asistance in respect of a child dependant. Inquiries are being made to establish that the child is a qualified dependant. When these inquiries are completed his unemployment assistance entitlement will be reviewed. In the meantime, weekly payment of £77.30 will continue to be made as they become due.

asked the Minister for Social Welfare when an appeal against a decision will be given in relation to a person (details supplied) in County Galway.

Following a review of his means by a social welfare officer, the unemployment assistance claim of the person concerned was disallowed from 7 December 1983 on the grounds that his means derived from land exceeded the statutory limit. He appealed against the decision and the case has been returned to the social welfare officer for further inquiries into his means. On completion of these inquiries the case will be referred to an appeals officer for determination.

asked the Minister for Social Welfare the position regarding the application for an old age pension by a person (details supplied) in County Offaly.

The person concerned is at present in receipt of a widow's non-contributory pension at the rate of £28.60 per week. Her entitlement to old age pension is being investigated and she will be notified of the outcome in due course.

If an old age pension is recommended by the social welfare officer at a more favourable rate than her widow's pension it will be put into payment on a provisional basis pending the local pension committee's decision.

asked the Minister for Social Welfare if he will state in relation to a person (details supplied) in County Mayo the amount allowed by the pension officer in lieu of bank interest when that person's income was being calculated in relation to his application for unemployment assistance; and if further investigation should be carried out in this case because of the fact that all income and expenditure were in the form of cheques.

The application of the person concerned for unemployment assistance on 30 May 1983 was disallowed on the grounds that his means derived from land exceeded the statutory limits in his case of £3,681.60 from 30 May 1983 and £4,053.40 from 29 June 1983. He appealed against the decision and an appeals officer confirmed the decision of the deciding officer. The amount of interest paid taken into account in assessing the applicant's means was £1,630.88.

asked the Minister for Social Welfare if all arrears of unemployment benefit due to a person (details supplied) in County Kilkenny will be paid at the earliest possible date.

The person concerned claimed unemployment benefit from 7 March 1983 to 22 August 1983. His claim was authorised at £30.50 weekly and increased to £33.55 from 30 June 1983. His first payment amounting to £30.50, made on 18 March 1983, was in respect of the period from 10 March 1983 to 16 March 1983 and allowed for three waiting days from 7 to 9 March. This was the payment which was referred to as arrears in the previous reply. Therefore, he has received all unemployment benefit due to him in respect of his claim.

asked the Minister for Social Welfare when a decision to grant a deserted wife's allowance will be made in respect of a person (details supplied) in County Cork as she has three children and is in poor circumstances.

The person concerned has been awarded deserted wife's benefit for herself and three qualified children at the weekly rate of £74.80 with effect from 25 August 1983. This is the appropriate rate of benefit based on an average of 42 contributions on her husband's insurance record over the period since his entry into insurance in 1972 up to the end of March 1983.

An order book payable from 16 February 1984 has been issued to the designated post office for collection by her, and she has been notified accordingly.

Arrears for the period from 25 August 1983 to 15 February 1984, less deductions in respect of supplementary welfare allowance paid to her by the Southern Health Board during that time, will be sent direct to the claimant by payable order inside the next few days.

asked the Minister for Social Welfare when the maximum rate of unemployment assistance will be paid to a person (details supplied) in County Wexford.

The application of the person concerned for unemployment assistance on 23 November 1983 was authorised at the weekly rate of £8.40 being the appropriate maximum rate in his case of £28.00 less means £19.60 derived from the value of board and lodging in his mother's home. A form on which to appeal against the amount of means assessed against him was issued to the applicant recently. If he completes and returns the form to his local office his case will be referred to an appeals officer for determination of his means. Weekly payments of £8.40 will continue to be made as they become due.

asked the Minister for Social Welfare the reasons for the delay in paying a living alone allowance to a person (details supplied) in Dublin 12.

The person concerned claimed living alone allowance on 16 November 1983 and the claim was referred to the local social welfare officer to verify that the pensioner is living alone. His report was recently received and living alone allowance was granted with effect from 20 October 1983.

The appropriate pension book was issued on 7 February 1984 and the arrears due have since been issued.

368.

asked the Minister for Social Welfare the reason occupational injury benefit is not being paid on a regular basis to a person (details supplied) in County Tipperary; when it will be paid; and the amount that will be paid weekly.

The person concerned claimed injury benefit from 15 November 1983 in respect of an incapacity which he attributed to an accident at work on that date.

Pending the completion of investigations arising from the accident he was paid disability benefit at the rate of £82.50 a week on an interim basis from 19 November, the fourth day of certified incapacity. This rate exceeded his reckonable weekly earnings in the tax year ended in April 1982 and accordingly he was not entitled to pay-related benefit.

Following the completion of investigations, injury benefit was awarded on 24 January 1984 at the rate of £95.60 a week from the date of the accident. Injury benefit over and above the disability benefit already paid on an interim basis to 11 January was paid and injury benefit has been paid to 8 February, the date of the latest medical certificate received.

Payments of benefit have issued regularly in respect of correctly completed medical certificates received. Some certificates received in December did not indicate the correct RSI number which resulted in delays in issuing payments.
