Vol. 357 No. 7

Written Answers. - Social Welfare Benefits.

729.

asked the Minister for Social Welfare when an appeal will be heard on a claim for unemployment benefit made by a person (details supplied) in County Mayo.

A date of hearing of the recent appeal application of the person concerned has not yet been fixed. An oral hearing of her case will be arranged to take place at the earliest opportunity and her entitlement to unemployment benefit will be reviewed in the light of the decision of the appeals officer.

730.

asked the Minister for Social Welfare the present position with regard to an appeal for farmers dole made by a person (details supplied) in County Limerick.

The person concerned appealed against the amount of means assessed against him and an appeals officer also assessed his means at £46.15 weekly derived from profit from his holding. The amount of means assessed against him exceeds the maximum rate appropriate to him and he is not entitled to unemployment assistance. He was notified accordingly.

731.

asked the Minister for Social Welfare when persons (details supplied) in County Wexford will be paid unemployment assistance; and the rate at which payment will be made.

The two persons named by the Deputy in the details supplied claimed unemployment assistance on the dates on which they attained the age of 18 years and their cases were referred to a social welfare officer for investigation of their means. Extensive inquiries are being made in these cases but it is expected that these will be completed shortly after which their means will be assessed and their entitlements to unemployment assistance will be determined accordingly.

732.

asked the Minister for Social Welfare if an application for a single woman's allowance will be reconsidered for a person (details supplied) in County Wexford in view of the fact that the means assessed against her were incorrect.

The single woman's allowance claim of the person concerned was disallowed on the grounds that her means derived from the capital value of a house and from the benefit of board and lodgings on her brother's holding exceeded the rate appropriate to her. She appealed against the decision and on 1 November 1984 an appeals officer also assessed her with means in excess of the rate of single woman's allowance appropriate to her.

However, her case was recently referred to a social welfare officer to reinvestigate her means following contentions made on her behalf that her circumstances had changed. When these inquiries have been completed, the assessment of her means will be reviewed and her entitlement to single woman's allowance will be determined accordingly.

733.

asked the Minister for Social Welfare if disability benefit payments will be issued to a person (details supplied) in County Wexford who is incapable of work; and if this case will be referred to an appeals officer as soon as possible.

Payment of disability benefit to the person concerned was disallowed from 10 January 1985 following examination by a medical referee who expressed the opinion that she was capable of work.

She did not appeal the disallowance. However, as the Deputy has indicated that she wishes to appeal, arrangements are being made to have her examined by a different medical referee at an early date. Her entitlement to further payment of disability benefit will be reviewed in the light of the medical referee's report following this examination.
