asked the Minister for Labour if he is aware that a person (details supplied) in Dublin 12 was due a cheque from his Department for unfair dismissal, which appears to have been paid to the liquidator of the company for which she previously worked but which appears to have been cashed by a person other than the person entitled to do so, who has had no communication from the liquidator; in view of the fact that she is now in arrears of mortgages and has not received the £1,303 due, if he will make a statement on the matter.

The person concerned, a former employee of the company, was awarded compensation under the Minimum Notice and Terms of Employment Act, 1973, and the Unfair Dismissals Act, 1977, by the Employment Appeals Tribunal on 21 April 1986. The liquidator of the company applied to my Department under the Protection of Employees (Employers' Insolvency) Act, 1984, for funds to pay the person concerned the compensation which had been awarded by the Employment Appeals Tribunal. A payment totalling £1,383 was issued to the liquidator from the redundancy and employers' insolvency fund on 6 November 1986 to enable him to pay the person concerned the awards made by the Employment Appeals Tribunal, in accordance with Statutory Instrument No. 356 of 1984.

I understand that the liquidator has so far failed to make the payment to the person concerned. Because of the liquidator's delay in making payment in this case my Department have referred the matter to their legal advisers. It is a cause of concern to me that the liquidator has so far failed to pay over the money issued to him on 6 November. I can assure the Deputy that I will take whatever action is necessary to ensure that this money is paid over to the person concerned as soon as possible. She will be kept informed of progress in the matter.
