asked the Minister for Health the number of occasions in the past five years on which complaints have been made or actions initiated against his Department for compensation as a result of clinical trials; and if he will make a statement on the matter.

No actions have been taken against my Department for compensation as a result of clinical trials in the last five years.

At present, there is no statutory basis on which the conduct of clinical trials could be controlled and complaints have been made about the absence of such statutory control. The purpose of the Control of Clinical Trials Bill which has been passed by the Seanad and is currently at Second Stage in the Dáil is to provide for such control.
