59.

asked the Minister for Social Welfare when a final decision will issue in a disability benefit appeal case for a person (details supplied) in County Mayo.

The person concerned was paid disability benefit to 12 September 1987 after which date payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance of benefit and was examined by a different medical referee on 17 November 1987 who also expressed the opinion that he was capable of work.

The appellant has now resubmitted a duly completed notice of appeal which has been referred to an appeals officer for decision.

asked the Minister for Social Welfare the reason disability benefit has been withdrawn in the case of a person (details supplied) in County Limerick; and the requirements which must be met in order that the benefit be restored.

The person concerned is not qualified for disability benefit as regulations provide that where a claimant has no contributions paid or credited for any two consecutive contribution years preceding his claim, he cannot qualify for payment of disability benefit or the award of credited contributions in respect of incapacity for work. According to the records of the Department the person has had no contributions paid or credited since 1966.

The person claimed disability benefit on 3 January 1987. Due to an administrative error he was incorrectly paid benefit to 1 March 1988, and benefit was withdrawn when the error was discovered. In order to qualify for the payment of benefit the person would first need to have paid a minimum of 26 contributions at the appropriate rate.

If the person's means are insufficient he may be entitled to supplementary welfare allowance and in this regard he should contact his community welfare officer.

62.

asked the Minister for Social Welfare when an invalidity pension will be granted to a person (details supplied) in Dublin 5.

The person concerned appears to satisfy the medical and contribution conditions for invalidity pension. It will be necessary for him to formally apply for pension by completing the appropriate claim form. A claim form was issued to him on 25 February last. This form has not yet been returned. A duplicate was issued on 22 April.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Wexford.

Payment of disability benefit to the person concerned was disallowed from 18 February 1988, following examination by a medical referee who expressed the opinion that he was capable of work.

Although the person concerned has continued to submit medical evidence of incapacity for work, he has not appealed against the decision to disallow payment of benefit.

If he is dissatisfied with the decision he should notify the Department in writing, stating the grounds on which he wishes to appeal.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 23 December 1987.

She was not entitled to benefit at the commencement of her claim as according to the available records she had less than the minimum of 39 contributions paid or credited in the year 1985-86, the contribution year governing her claim.

From 4 January 1988, her claim is governed by the 1986-87 contribution year. She had sufficient contributions paid and credited in the 1986-87 year to qualify for benefit at the reduced rate of £40.70 from 4 January 1988.

All benefit payable to 6 April 1988, the date of the latest medical certificate received has been issued to her.
