asked the Minister for Social Welfare the outcome of the appeal of a person (details supplied) in County Kilkenny for disability benefit.

The person concerned claimed disability benefit on 14 July 1987 but was not eligible for payment as he had less than the required 39 contributions in the 1985-86 contribution year which governed his claim. He continued to submit medical evidence of incapacity and was awarded credited contributions up to 26 October 1987 when, following an examination by a medical referee who considered him to be capable of work, the award of further credited contributions ceased. He was subsequently certified fit for work by his own doctor on 23 November 1987.

He has made a further claim to disability benefit from 25 March 1988 but does not qualify for payment on this claim either as he does not have the necessary minimum of 39 contributions in the 1986-87 tax year. He is, however, being awarded credited contributions in respect of this claim. This person is being referred for a further medical examination. His position will be reviewed in the light of the outcome of this examination.
