asked the Minister for Social Welfare the present position regarding the application of a person (details supplied) in County Waterford for an Irish invalidity pension.

The person concerned is in receipt of an invalidity pension from the Department of Health and Social Security in Britain. Under EC regulations No. 1408/71 on the Social Security of Migrant Workers the country in which a claimant was last insurably employed is the only country that can aggregate the insurance record of a claimant to qualify him for payment of disability benefit or invalidity pension.

As the person concerned was last insurably employed in England the payment of invalidity pension remains the responsibility of the United Kingdom Authorities and he is not entitled to an Irish invalidity pension. However, when he reaches pensionable age in either member state the person concerned will then qualify for a pro-rata pension based on his insurance record in each member state where he was insurably employed.

asked the Minister for Social Welfare the reason a person (details supplied) in County Louth has had her disability benefit discontinued to her; if his attention has been drawn to the fact that this person was in receipt of disability benefit from 6 April 1986 to 5 April 1987 and as such has 52 credited contributions and therefore is in full benefit; and when payment of same will be made.

The person concerned was in receipt of disability benefit from 9 June 1986 to 4 April 1988 after which date she was certified fit to resume work by her doctor. Payment was issued at the maximum personal rate plus an increase in respect of two dependent children.

All benefit payable in respect of her claim has been issued to her and credited contributions were awarded in respect of the period of incapacity. No subsequent claim to disability benefit has been received from this person.
