Written Answers. - Milk Cessation Scheme.

78.

asked the Minister for Agriculture and Food if he will clarify the position of dairy farmers who ceased milking in the late seventies under the five year scheme, in view of last week's European Court of Justice decision.

82.

asked the Minister for Agriculture and Food the steps he is taking to secure additional milk quota to cover the entitlement of those who temporarily opted out of milk production and who are now entitled to resume such production pursuant to the decision of the European Court of Justice.

83.

asked the Minister for Agriculture and Food if his attention has been drawn to the recent judgment of the European Court of Justice in favour of the restoration of quotas to farmers in Holland and Germany who, as a result of various temporary milk cessation schemes, were not in production in 1983, the reference year; and if he is prepared to extend the findings of the court to similar situations in Ireland.

asked the Minister for Agriculture and Food if, in view of the recent ruling by the European Court of Justice, quotas will be made available to farmers wishing to come back into dairying.

I propose to take Questions Nos. 78, 82, 83 and 93 together.

The implications of the decision by the European Court of Justice are being examined at present by the legal services of the European Commission with a view to deciding what amendments are required to the Community regulations on the quota system. Any action required here will be decided on in the light of these amendments.
