asked the Minister for Labour if, in view of a recent Labour Court recommendation concerning the rights of part time workers in a redundancy situation, he considers that any updating of protective legislation is necessary.

In relation to much of the protective legislation administered by the Department of Labour no distinction is made between full and part time workers. Legislation such as the Conditions of Employment Acts, 1936 to 1944, the Payment of Wages Act, 1979, the Anti-Discrimination (Pay) Act, 1974, and the Employment Equality Act, 1977, applies to all workers irrespective of the number of hours worked.

The Labour Court determination referred to relates to a case taken under the Employment Equality Act 1977 on the issue of discriminatory selection for redundancy and does not have direct legal implications for the generality of part time workers. I propose, however, to have the issue of part time working reviewed and to consider whether in the light of present trends our legislative provisions warrant revision to provide a basis for employment standards in this area.
