asked the Minister for Social Welfare the correct amount of invalidity pension payable in the case of a person (details supplied) in County Kildare who has one dependant; and if he will make a statement on the matter.

The person concerned is at present in receipt of invalidity pension at the rate of £67.05 per week. This consists of £50 per week personal rate less £3 deductions to recover an outstanding disability benefit overpayment, £9 adult dependant alleviation allowance, £5.80 half-rate child dependant allowance and £5.25 half-rate child dependant alleviation payment.

The person concerned has received a free travel pass. He has made an application for a free electricity allowance and his entitlement to this is currently under consideration.

asked the Minister for Social Welfare if a person (details supplied) in County Kildare who is currently in receipt of disability benefit will qualify for invalidity pension as his consultant states he is permanently unfit for work; and if he will make a statement on the matter.

The person concerned would appear to satisfy the medical and contribution conditions for invalidity pension. A claim form has been issued to the applicant. On return of the completed form, a decision will be made on entitlement.

asked the Minister for Social Welfare the reason for the delay in restoring disability benefit to a person (details supplied) in County Kerry.

An oral hearing of the appeal of the person concerned was held on 25 October 1988. In the course of the hearing a medical report was submitted by the appellant to the appeals officer. As a consequence a further medical referee examination was held on 20 December 1988 following which the medical referee expressed the opinion that the person concerned was capable of work.

In the light of all the evidence the appeals officer subsequently decided that the person concerned was not incapable of work within the meaning of the Social Welfare Acts from 2 October 1987 and is not entitled to be paid disability benefit from that date. The person concerned has been informed of the appeals officer's decision.
