asked the Minister for Social Welfare when a person (details supplied) in County Kerry will receive disability benefit.

Under EC legislation, a person's country of last employment is responsible for claims to sickness benefit.

As the person concerned was last insurably employed in Great Britain, his claim for disability benefit has been transferred to the Department of Health and Social Security, Newcastle-upon-Tyne, who will be in touch with him in due course.

asked the Minister for Social Welfare if an invalidity pension is payable in the case of a person (details supplied) in County Kildare; and if he will make a statement on the matter.

Invalidity pension is payable to insured persons who satisfy the contribution conditions and who are permanently incapable of work.

Arrangements are being made to have the person concerned examined by a medical referee of the Department. He will be notified of the time and place of examination as soon as arrangements have been completed. His entitlement to invalidity pension will be determined in the light of the report of that examination.

asked the Minister for Social Welfare the reason disability benefit was not paid to a person (details supplied) in County Louth.

The person concerned claimed disability benefit from 7 May 1988. He was examined by a medical referee on 29 June 1988 and found to be capable of work. Payment of benefit was disallowed from 7 July 1988. He submitted a final medical certificate stating that he was fit to resume work on 13 July 1988. He did not exercise his right to appeal the disallowance.

He submitted a further claim to benefit from 18 October 1988. As there was no change in his incapacity and as he had not resumed work since 7 July 1988, payment of benefit was suspended, pending the outcome of a medical referee examination. The person concerned was examined on 1 December 1988 and found to be capable of work. His claim from 18 October 1988 was disallowed and he was given the right to appeal.

He submitted a final medical certificate, stating that he was fit to resume work on 12 December 1988. As he did not exercise his right to appeal within 21 days, his claim has been closed.

asked the Minister for Social Welfare when a medical examination will be arranged for a person (details supplied) in County Westmeath in order that his entitlement to disability benefit can be determined.

The person concerned was paid disability benefit to 29 October 1988, after which date payment was disallowed following an examination by a medical referee who considered him to be capable of work. He appealed against this decision and was examined by another medical referee on 8 December 1988 who also expressed the opinion that he was capable of work. He has now completed the appropriate appeal form and his case is being submitted to an appeals officer for determination.
