Written Answers. - Delay in Appeal Hearing.

asked the Minister for Social Welfare the reason for the delay in the hearing of the appeal of a person (details supplied) in County Cork whose disability benefit and disablement benefit were discontinued recently, and if he will ensure that this case is heard immediately.

The person concerned was in receipt of disability benefit and also disablement benefit in respect of the effects of an accident at work on 31 October 1987. He was examined by a medical referee on 8 December 1988 who expressed the opinion that he was capable of work. His disablement which has been assessed provisionally at 20 per cent was reassessed at 10 per cent for a further six months and payment of disability benefit was disallowed from 16 December.

The claimant appealed against both decisions. Arrangements have been made to have him examined on 24 February 1989 by a different medical referee. The decisions will be reviewed in the light of the results of that examination.
