asked the Minister for Justice if the Garda are consulted in all cases where the holders of bookmakers' licences sell their premises and licences to another company.

The procedure for the authorisation of bookmakers to conduct business in the State is set out in the Betting Act, 1931. The general control is vested in the Minister for Finance and the Revenue Commissioners who exercise control of licensed premises by means of a registration system under the Act. The Garda Síochána are involved since — as a preliminary to the registration of premises by the Revenue Commissioners — a certificate of personal fitness must be obtained by the bookmaker from his local superintendent and a certificate of suitability of premises must be obtained from the superintendent in whose district the premises are located. This means that the Garda need not be consulted in a case in which a person acquiring a suitable premises has already got a certificate of personal fitness.
