Vol. 393 No. 2

Written Answers. - Family Home Ownership Rights.

100.

asked the Minister for Justice if it is his intention to introduce legislation in the form of a matrimonial property Bill, which would give each spouse equal rights of ownership in the family home; and if he will make a statement on the matter.

Legislation to give each spouse equal rights in the ownership of the family home and contents is under preparation in my Department. However, a number of legal difficulties of a particularly complex nature have arisen and have delayed progress.

In addition, a recent High Court decision which is under appeal to the Supreme Court has implications for the proposed legislation. I will not be in a position to finalise my proposals until the judgment of the Supreme Court in the case has been given and considered.
