Vol. 394 No. 5

Written Answers. - Social Welfare Benefits.

100.

asked the Minister for Social Welfare when a decision will be made regarding the old age pension application of a person (details supplied) in County Kilkenny.

Following investigation of the case, a deciding officer decided on 28 November 1988 that the person concerned was entitled to non-contributory pension at a weekly rate of £18.30, which includes a £3.80 living alone allowance, with effect from 16 September 1988. This is the rate of pension appropriate to a person with weekly means of £38.21 per week.

The person concerned lodged an appeal against the means assessed against him. An oral hearing of the case took place on 26 July 1989. At this hearing the solicitor of the person concerned undertook to provide documentation in support of his client's appeal. A letter has issued to the solicitor on 4 October 1989 requesting that all documentary evidence in support of the appeal be submitted as soon as possible.

asked the Minister for Social Welfare when unemployment assistance will be restored to a person (details supplied) in County Kildare who denies that he has at any time been self-employed other than when he informed his Department; if he will pay all arrears involved with particular regard to the fact that this person has had to approach the Society of St. Vincent de Paul in order to meet grocery bills; and if he will make a statement on the matter.

The position in this case has not altered since my reply to the Deputy of 16 November. An appeal form was issued to the person concerned on 14 November and to date there is no trace of it having been returned. It will be necessary for him to supply details of his income from self-employment to allow his means to be determined.
