asked the Minister for Education the way in which the European Court of Justice decision on the Gravier case, which gave a right of access to university studies to nationals of other EC States, will affect the operation of the Irish points system which is based solely on Irish leaving certificate results.

The decision in the Gravier case related essentially to the right of a national of a member state of the European Community to attend a higher education institution in another member state at the same level of fees as apply to nationals of the country concerned.

Our higher education institutions charge the same fee to nationals of other member states of the European Community as apply to Irish students.

It is possible under the present system to gain admission to higher education institutions here through the Central Applications Office on the basis of examinations other than the leaving certificate. This would include second level schools leaving qualifications from Europe and indeed elsewhere.
