Vol. 394 No. 8

Written Answers. - Ownership of Property.

Garrett Fitzgerald

Ceist:

321 Dr. G. FitzGerald asked the Minister for the Environment if he will introduce legislation as a matter of urgency to compel legal representatives, acting on behalf of owners of property, to disclose the ownership of property where an unauthorised development has been undertaken, with particular reference to a case (details supplied) in Dublin 6.

Where the name of the owner or of the occupier of any land or premises cannot be ascertained by reasonable inquiry, a planning authority may address any notices under the Planning Acts, including enforcement notices in relation to unauthorised development, to "the owner" or "the occupier" without naming him.

While I have no immediate legislative proposals in respect of the matter referred to by the Deputy, I intend to examine the adequacy of enforcement powers generally under the Planning Acts in the course of a review of that legislation.
